Legal Perspective: Why Ontario’s OINP Skilled Trades decision is being questioned

Immigration Lawyer Mr. Jaswant Mangat  joined us on the Morning Show Shameel Jasvir to provide legal insight into the ongoing OINP issue. He argued that Ontario’s decision to reject more than 2,600 applications under the OINP Skilled Trades Stream is unjust . He says when the government invites applications, it creates an expectation that the program will continue and that files will be processed fairly. Cancelling an entire stream years later, rather than rejecting applications individually for valid reasons, is unfair. 

Mangat points to a past federal immigration case as precedent, where courts ruled in favour of applicants after the government changed immigration rules without notice. He stresses that many of those affected by the OINP decision are skilled workers and international graduates who have lived and worked in Canada for four to six years, paid international tuition fees, and contributed to the economy. Mangat said Ontario should either reinstate the Skilled Trades Stream or collaborate with the federal government to provide temporary relief, such as Temporary Resident Permits (TRPs) ,for individuals at risk of losing their legal status.
