The truck driver responsible for the 2018 Humboldt Broncos bus crash is closer to being removed from Canada after federal immigration officials rejected his bid for refugee protection.
Michael Greene, lawyer for Jaskirat Singh Sidhu, said Immigration, Refugees and Citizenship Canada has denied a pre-removal risk assessment, clearing the way for deportation to India.
“With that decision, the Canada Border Services Agency now has a legal obligation to proceed with removal,” Greene said, adding he plans to seek a temporary deferral while another application remains under review.
Sidhu, a rookie Calgary truck driver at the time, ran a stop sign at a rural Saskatchewan intersection in April 2018, colliding with a bus carrying the Saskatchewan Junior Hockey League team. Sixteen people were killed and 13 others injured, prompting nationwide mourning.
He pleaded guilty to dangerous driving causing death and was sentenced to eight years in prison. Sidhu, who came to Canada as a permanent resident in 2014, was released on full parole in 2023. The Immigration and Refugee Board ordered his deportation the following year, as permanent residents convicted of serious crimes are inadmissible under Canadian law.
Greene said the refugee claim was unlikely to succeed but delayed removal while it was under consideration. He is now weighing an appeal and plans to request a deferral based on humanitarian grounds, citing Sidhu’s two children, one of whom has complex medical needs.
Chris Joseph of St. Albert, Alta., whose son Jaxon died in the crash, said he hopes the deportation proceeds.
“This would close an important chapter for our family,” Joseph said. “It might be the only thing that brings a small measure of peace.”
